State sovereign immunity, as confirmed by the U.S. Supreme Court's decision in Allen v. Cooper, creates barriers for authors seeking redress against state entities. Balancing the rights of creators with public access and fostering innovation is critical. This research paper discusses these issues and emphasizes the need for effective redress mechanisms, transparency, and accountability to ensure fair outcomes in copyright law.
